GENERAL CONDITIONS
Online purchase of FADEIN products
These General Conditions shall apply to all purchases of products offered through the web page https://fadein.es (hereinafter “Products”), and together with the offer, price and description of the same fixed through said web page, and, if applicable, the particular conditions of the same contained in this document (particular conditions), shall govern the legal relationship between Fadein, S.L. hereinafter (Fadein), the provider of the web page https://fadein.esy the CUSTOMER, making up the entire agreement between FADEIN and the CUSTOMER.
The period of validity of these General Conditions of Contract shall be the time they remain published on the website, and shall refer to the purchase of Products at the time these conditions were available.
We are sorry, but we can only accept purchases made by persons of legal age. If you are a minor, you must inform your parents or guardians about these General Conditions of Purchase. It is your parents or guardians who must express their acceptance of them before using this website or making any purchase on it.
Identification of the parties
On the one hand, FADEIN, S.L. hereinafter “Fadein”, with CIF B80434087, domiciled at Calle Valconete 4-6 28511 Valdilecha, and registered in the Commercial Registry of Madrid, Volume 11.910, Folio 205 and Page M-74908.
On the other hand, the CLIENT, of legal age, whose data are those that have been entered by him/her in the corresponding forms. All data included in these forms have been entered directly by the CLIENT, so the responsibility for the authenticity of the same corresponds directly and exclusively to the CLIENT.
Object of the contract
Through the acceptance of these general conditions, FADEIN undertakes to make available to the CUSTOMER the Products purchased through the website https://fadein.es and the CUSTOMER undertakes to pay the price indicated at the time of purchase.
Registration process
In order to purchase the Products offered by FADEIN through its website, https://fadein.es, it is necessary to register on the website. The CLIENT may register at any time before starting the reservation process, or, if applicable, before confirming the reservation.
In order to register you must be of legal age according to Spanish law, and you must include your date of birth in the registration form.
In connection with the registration process, the CLIENT is solely responsible for the quality of the data entered by him/her in the forms, and accepts the obligation to provide truthful, accurate and complete data about his/her identity, as requested in the registration, purchase and accreditation forms, as well as to update all registration data so that they remain truthful, accurate and complete.
The CLIENT may at any time modify and/or update their data by accessing their User profile in the “MY ACCOUNT” section of the portal, but we recommend that they always confirm that the data entered and/or modified are correct, especially their e-mail address and contact telephone number, in order to avoid future inconveniences.
Once the CLIENT has entered his/her data and clicked on the registration button, we will send him/her a confirmation e-mail in order to authenticate the data provided during registration. The sending and receipt of such e-mail is usually automatic and in any case within 24 hours of sending the registration request. If you have not received it within that period of time, it may be due to an occasional communications failure or an error in the e-mail address you have provided. In both cases, please contact us as soon as possible by e-mail at [email protected].
If the CLIENT provides any false, inaccurate or incomplete information, or if FADEIN has sufficient reason to suspect that such information is false, inaccurate or incomplete, it shall have the right to deny access and present or future use of the website, or any of the services.
Privacy Policy / Cookies
In accordance with the provisions of current data protection regulations – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, and regulations that develop it, the personal data of the CLIENT will be part of a file used exclusively for the management of purchases made through the website. https://fadein.es as well as to send you information about our offers and promotions, assuring the CLIENT the confidentiality of their data.
At any time the CLIENT may exercise the rights of access, rectification, cancellation, opposition of the data collected and refuse consent previously provided at [email protected] or by WhatsApp. The CLIENT, to learn more about what we do with your data or how to exercise your rights, you can visit our Privacy Policy and Cookie Policy.
Products
All information on the Products offered by FADEIN, including, but not limited to, prices, characteristics, description, size, content, etc., are available to the CUSTOMER on FADEIN’s website, and will appear on screen in each case.
We try that the descriptions of the products that the CLIENT will be able to visualize next to each one of them are as exact and useful as possible. However, the colors displayed by the CUSTOMER on its screen may vary from the original color of the product.
The photographs and data included in each product sheet are for information purposes only, therefore, FADEIN declines any responsibility for the appearance of errors in such information.
Prices
The characteristics and prices of the Products for the Spanish market are shown on the screen in Euros including VAT. Taxes will at all times be those in force and will be included in the shopping cart and on the invoice in itemized form.
In case the Customer has special conditions and discounts, they will also appear on the screen.
The prices shown on the website override all previously published prices and are in effect at the time of publication. FADEIN undertakes to make every effort to maintain these prices, although it reserves the right to modify them without prior notice, informing the customer at the time of placing an order. Price changes will not affect orders already placed.
Purchasing System
In general, in order to purchase the products offered through the website https://fadein.es it is necessary to be registered in the same accepting the legal notice and the corresponding privacy policy.
The personal data must be indicated accurately to avoid confusion or incidents in the provision of the Service and delivery of the products purchased.
The products to be purchased must be selected and added to the shopping cart by clicking on the corresponding icon.
After selecting the desired Products, in order to purchase them, the CUSTOMER must access the shopping cart, where he/she must fill in the corresponding purchase form that will appear on the screen, together with a summary identifying the selected Products, their total price, the applicable taxes and, if applicable, the applicable shipping costs.
The verification of such data shall be the sole and exclusive responsibility of the CUSTOMER. Fadein shall not be liable to the CUSTOMER for any errors or inaccuracies in the order if Fadein had sent the Products stated in the order confirmation.
Once the purchase form is completed, the CLIENT must accept the present Conditions, once accepted, select the desired payment method and confirm the Purchase. Depending on the payment method selected, the CLIENT may be redirected to an on-line payment platform where he/she can finalize the purchase through any of the accepted payment systems.
Once the transaction is confirmed, the CUSTOMER will receive a communication by e-mail with the information of his/her order. Non-receipt of this message may be due to a temporary problem in network communications or a typing error in the e-mail address provided. In both cases, it is advisable for the CUSTOMER to contact customer service through the e-mail address [email protected] or by WhatsApp.
It is also advisable that the CUSTOMER reviews the data included in this email, and in case of detecting any error, contact customer service through the email address [email protected] or by WhatsApp.
Payment methods and security
Fadein accepts reservations at any time, 24 hours a day, every day of the week.
For those CUSTOMERS who have a relationship with Fadein prior to the purchase, the method of payment may be the one previously agreed between the CUSTOMER and Fadein. In the absence of an agreement, as well as for new CUSTOMERS, we will only accept payments made by VISA, MASTERCARD or AMERICAN EXPRESS credit card. No other form of payment other than the above mentioned will be accepted.
In this case, the charge will be made on-line, that is to say, in real time, through the virtual POS (Point of Sale Terminal) provided by Banco Santander, once it has been verified that the data provided are correct.
The confidential data (credit card number, expiration and CVV) are not sent to our server, but are transmitted directly and in encrypted form to Banco de Santander’s server, without Fadein having access to them.
Fadein reserves the right to withhold any order for security reasons, as well as to temporarily deny access to the Products purchased. The affected CUSTOMERS will be informed. Likewise, FADEIN reserves the right to cancel an order if it considers that the data provided by the CUSTOMER cannot be verified, or if it considers that the Product has been contracted by the CUSTOMER for resale.
FADEIN will not be responsible for delays in the delivery of orders resulting from the lack of authorization by the payment system.
Delivery
FADEIN delivers products and services throughout Spain except the Canary Islands. The costs will be borne by the CUSTOMER unless otherwise indicated on the website and will appear on the screen at the time of purchase, along with the estimated delivery time.
The delivery times of the products indicated at the time of placing an order are estimates and are not linked to specific delivery times. In any case, the maximum estimated delivery period will be 6 working days from the processing of the order.
At this time, FADEIN does not ship Products internationally.
Orders will be processed within 48 working hours after confirmation of the order and validation of the payment method. The CLIENT will be able to check the status of his order at any time by accessing the “MY ACCOUNT” section.
In case of force majeure that prevents or delays the delivery of the product and/or service, the CLIENT will be informed with the proposal of a new date of delivery of the Product without any liability for FADEIN. Force majeure shall be understood as any case that prevents the delivery of the order for reasons beyond the control of either party, such as, but not limited to, strikes, war, flood or other natural catastrophe, lack or impossibility of supplying materials, etc.
Deliveries will be made to the address provided by the CUSTOMER. No deliveries are made to post office boxes.
All deliveries must be signed for upon receipt. Once the goods have been signed for, it is the responsibility of the CUSTOMER.
In order to avoid incidents in the delivery it is essential to fill in the corresponding form correctly, being obligatory to fill in the box related to the contact telephone number and e-mail.
Billing. General conditions e-Invoice.
Upon acceptance and in accordance with the provisions of R.D.16/19/2012 of November 30, 2012, which approves the Invoicing Regulations, the invoices that FADEIN will send you will be subject to the following procedure:
The invoice will be generated in PDF and will be sent as an attachment by e-mail to the address provided for this purpose. We have enabled a specific e-mail address for the review of electronic invoices, so that this will be the only channel for sending these invoices. The e-mail address established for this purpose is: [email protected]
In case you decide to revoke this consent, it will be enough to communicate it to us by email to [email protected] or by WhatsApp.
Order Cancellation
The CLIENT may cancel without any charge the order of any product, as long as the order has not been shipped.
To make the cancellation, the CUSTOMER should contact the customer service department through the e-mail address [email protected] or by WhatsApp.

If the order has been delivered, it cannot be cancelled. However, the CUSTOMER may return his order once he has received it, in accordance with the following return conditions.
Withdrawal, returns and exchanges
In case the CUSTOMER after receiving the purchased Product is not satisfied, the CUSTOMER has a period of 14 calendar days from the date of receipt of the order to execute the right of withdrawal, return or exchange.

In this sense, in order to exercise the right of withdrawal, return or exchange of the purchased product, the following conditions must be met:

o Withdrawal
The CLIENT has the right to withdraw from this contract within 14 calendar days without justification.
The withdrawal period shall expire 14 calendar days from the day on which the CUSTOMER or a third party indicated by him, other than the carrier, acquired material possession of the product.
To exercise the right of withdrawal, the CUSTOMER must notify us of their decision to withdraw from the contract by contacting FADEIN by email at [email protected] or by WhatsApp.

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiration of the withdrawal period.
Consequences of withdrawal:
In the event of withdrawal by the CUSTOMER, we will refund all payments received for the purchase, including delivery charges (with the exception of additional costs resulting from the CUSTOMER’s choice of a delivery method other than the least expensive ordinary delivery method offered by us) without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make such reimbursement using the same means of payment used by the CUSTOMER for the initial transaction, unless the CUSTOMER has expressly provided otherwise; in any case, the CUSTOMER will not incur any costs as a result of the reimbursement.
Notwithstanding the foregoing, we may withhold reimbursement until we have received the Products, or until the CUSTOMER has provided proof of return of the Products, whichever condition is met first.
The CUSTOMER must return the goods to us by attaching the completed form and by means of the carrier assigned by FADEIN. The delivery address will be Calle Valconete 4-5, Valdilecha, Madrid.
In any case, the return of the goods shall be made without undue delay and at the latest within 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. The deadline shall be deemed to have been met if you return the goods before the deadline has expired.
The CUSTOMER shall bear the direct cost of returning the Product.
The CUSTOMER shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Products purchased.
o Return
Returns will only be accepted for defective products or shipping errors by FADEIN. The CUSTOMER may request its return, within 14 calendar days after the acquisition of the material possession of the product. After this period, if the purchased product has any manufacturing or quality defect, the CUSTOMER may enforce the legally recognized warranty.

To accept the return of a product, it must arrive at FADEIN in its original packaging, completely sealed and undamaged. It is the customer’s obligation to keep a signed copy of the delivery documentation provided by the carrier.
Once we have received the product and checked its condition, we will proceed to send the correct product at no additional cost to the CUSTOMER, unless the CUSTOMER requests a refund, in which case the full amount paid for the product will be refunded within 10 working days. The refund will be made automatically using the same payment method used for the initial transaction.
o Changes
To request a product exchange, the CUSTOMER must contact customer service within 14 calendar days after acquiring material possession of the product.
Shipping and collection costs in case of exchange shall be borne by the CUSTOMER. No freight collect shipments will be accepted under any circumstances.
After-sales service
FADEIN has a Customer Service through the e-mail address [email protected] or by WhatsApp.
The chemical products offered through our website are guaranteed for 1 year. To make use of the warranty within the established legal term, it will be essential to present the proof of purchase. You can do it through the e-mail address [email protected].
The warranty does not cover those cases in which the wear or defect is caused by misuse of the product by the CUSTOMER, wear of the product by normal use thereof, or by deficiencies caused by negligence, blows, improper use or manipulation, or materials subject to wear by normal use, as well as those cases in which some of the warranty information or proof of purchase has been modified, altered or replaced and/or the product has been manipulated or repaired by third parties outside FADEIN.
In those cases that justify the use of the warranty, we will opt for the repair, replacement of the article, discount or refund, in the legally established terms.
FADEIN may also offer an Additional Commercial Warranty, although such additional commercial warranty may be limited to certain products or certain specific characteristics. In such case, it will be specified in each case in the product description accessible through the Web.
Intellectual and industrial property
FADEIN guarantees the CLIENT to be the holder of the intellectual and industrial property rights over the Products sold and/or, if applicable, to have the necessary authorization for the commercialization of the same through its website.
The CLIENT acknowledges and accepts that the Products, as well as their contents, packaging, materials, etc., are subject to Intellectual and Industrial Property rights, the ownership of which corresponds to FADEIN and/or third parties.
The acquisition of the Products and the navigation through FADEIN’s website shall in no case be understood as a waiver, transmission, license or total or partial transfer to the CLIENT of the intellectual and industrial property rights owned by FADEIN or, if applicable, by the third party to which they correspond. The CLIENT may not in any case alter, exploit, reproduce, distribute or publicly communicate the Website, its contents or the products acquired through the same, without the prior and express authorization specifically granted, to that effect, by FADEIN or, where appropriate, by the third party to which they correspond.
Modification of Conditions
FADEIN reserves the right to modify this agreement, when deemed appropriate or in order to adapt such texts to legislative or technological changes or to its contractual relationship with third parties. The CUSTOMER shall be duly informed of such modifications.
Partial nullity
Should any part of these terms and conditions be unlawful and therefore invalid, this shall not affect the other provisions which are in accordance with the law. The parties undertake to renegotiate those parts of the terms and conditions that are null and void and to incorporate them into the rest of the terms and conditions.
Disclaimer of warranties and liability
FADEIN shall not be liable for any delays or failures that may occur in the access, functioning and operation of the website, or in its Products, nor for any interruptions, suspensions or malfunctioning of the same for reasons beyond FADEIN’s control or when they have their origin in breakdowns caused by natural disasters or situations of force majeure, or extreme urgency, such as strikes, attacks or computer intrusions (computer viruses that affect the users’ devices) or any other situation of force majeure or fortuitous cause.
FADEIN reserves the right to interrupt access to its website www.fadein.es, as well as the provision of any or all of the content provided through the same at any time and without prior notice, whether for technical, security, control, maintenance or any type of failure in telecommunications networks or power supply.
FADEIN shall not be liable in case of service failures, malfunctions or any other cause that it does not have direct control over them or that has its origin in willful or negligent actions of the user or due to force majeure or attributable to third parties.
FADEIN is not responsible for any information, data, images of any kind and links published on its website from third parties and does not assume any guarantee on the truthfulness and accuracy of the information made available to CUSTOMERS or provided by CUSTOMERS themselves.
Likewise, it shall not assume any liability whatsoever for direct or indirect damages, consequential damages and/or lost profits.
The CLIENT shall hold FADEIN harmless from any liability that may arise from third party claims regarding the infringement of rights that may result from its performance.
Conflict Resolution
These General Conditions are governed by applicable Spanish law.
The intervening parties undertake to resolve amicably any differences that may arise in relation to these conditions. In the event that an amicable solution is not possible, and if a legal dispute arises, both parties agree to submit to the jurisdiction and competence of the Courts of Madrid, expressly waiving any other jurisdiction that may correspond to them, and provided that the Law so permits, to the jurisdiction and competence of the Courts of Madrid.
